This Luggage Storage Agreement (the “Agreement”) is entered into by the customer (“Storer”) and Store & Snore (“Provider”). By agreeing to these terms and conditions, the Storer acknowledges and agrees to the following:
1. Service Overview
The Provider offers storage services for personal belongings, including but not limited to luggage, bags, and packages. This Agreement governs the terms and conditions under which the Provider will store items on behalf of the Storer.
2. Prohibited Items
The Storer agrees not to store the following prohibited items:
a. Hazardous materials, including flammable, explosive, or toxic substances.
b. Perishable goods or any items that may decay or cause odors.
c. Illegal substances or items prohibited by law.
d. Firearms, weapons, or ammunition.
e. Cash, jewelry, or high-value items exceeding $500 in value.
f. Items deemed unsafe or inappropriate by the Provider.
The Provider reserves the right to inspect items if there is reasonable suspicion of prohibited contents. Any violation of this clause will result in immediate termination of the storage agreement.
3. Payment Agreement
a. Storage fees are calculated based on the size and duration of storage and will be communicated to the Storer prior to the agreement.
b. Payment is due at the time of booking and is non-refundable.
c. Any additional fees, including extended storage charges, must be paid before belongings are retrieved.
4. Security and Liability
a. The Provider will take reasonable measures to ensure the safety and security of stored belongings.
b. The Provider is not liable for any loss, damage, or theft of stored items, except in cases of gross negligence or willful misconduct.
c. The Storer assumes full responsibility for ensuring all items are securely packed and sealed to prevent leaks, spills, or damage.
5. Termination and Retrieval
a. The Storer must retrieve belongings within the agreed-upon timeframe.
b. Failure to retrieve items within this timeframe may result in additional storage fees of $5 for up to two hours or $10 for overnight storage past operating hours.
c. If belongings are not retrieved within 14 days of the agreed-upon retrieval date, the Provider reserves the right to dispose of or donate the items without further liability.
6. Dispute Resolution
a. Any disputes arising from this Agreement shall first be resolved through mediation, with the costs of mediation shared equally between the parties.
b. If mediation is unsuccessful, the parties agree to submit to the exclusive jurisdiction of the courts of Davidson County, Tennessee.
7. Amendment and Modification
This Agreement may only be amended or modified in writing and signed by both parties.
8. Entire Agreement
This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior agreements and understandings, whether written or oral.
9. Acknowledgment and Consent
By agreeing to these terms, the Storer confirms they have read, understood, and accepted the terms and conditions set forth in this Agreement.
10. Additional Provisions
a. Force Majeure: The Provider is not responsible for delays or inability to perform services due to circumstances beyond its control, including but not limited to natural disasters, acts of terrorism, or government actions.
b. Non-Transferability: This Agreement is personal to the Storer and cannot be assigned or transferred without the Provider’s prior written consent.
c. Contact Information: The Storer is responsible for providing accurate contact information and notifying the Provider of any changes.
